1. Acceptance of our Terms

By visiting the website www.kangadocarports.com, viewing, accessing or otherwise using any of the services or information created, collected, compiled or submitted to www.kangadocarports,com, you agree to be bound by the following Terms and Conditions of Service. If you do not want to be bound by our Terms your only option is not to visit, view or otherwise use the services of KANGADO. You understand, agree and acknowledge that these Terms constitute a legally binding agreement between you and “Kangado carports” and that your use of www.kangadocarports.com shall indicate your conclusive acceptance of this agreement.

2. Provision of Services

You agree and acknowledge that KANGADO is entitled to modify, improve or discontinue any of its services at its sole discretion and without notice to you even if it may result in you being prevented from accessing any information contained in it. Furthermore, you agree and acknowledge that KANGADO is entitled to provide services to you through subsidiaries or affiliated entities.

3. Proprietary Rights

You acknowledge and agree that www.kangadocarports.com may contain proprietary and confidential information including trademarks, service marks, photos, videos, drawings, instructions and patents protected by intellectual property laws and international intellectual property treaties. www.kangadocarports.com authorizes you to view and make a single copy of portions of its content for offline, personal, non-commercial use. Our content may not be sold, reproduced, or distributed without our written permission. Any third-party trademarks, service marks and logos are the property of their respective owners. Any further rights not specifically granted herein are reserved.

4. Submitted Content

When you submit content to www.kangadocarports.com you simultaneously grant www.kangadocarports.com an irrevocable, worldwide, royalty-free license to publish, display, modify, distribute and syndicate your content worldwide. You confirm and warrant that you have the required authority to grant the above license to www.kangadocarports.com

5. Termination of Agreement

The Terms of this agreement will continue to apply in perpetuity until terminated by either party without notice at any time for any reason. Terms that are to continue in perpetuity shall be unaffected by the termination of this agreement.

6. Disclaimer of Warranties

You understand and agree that your use of www.kangadocarports.com is entirely at your own risk and that our services are provided “As Is” and “As Available”. www.kangadocarports.com does not make any express or implied warranties, endorsements or representations whatsoever as to the operation of the www.kangadocarports.com website, information, content, materials, or products. This shall include, but not be limited to, implied warranties of merchantability and fitness for a particular purpose and non-infringement, and warranties that access to or use of the service will be uninterrupted or error-free or that defects in the service will be corrected.

Please Note:

PURCHASING, COUNCIL PERMITS, DAMAGE PRODUCTS, WARRANTIES AND CANCELLING

a) It is the responsibility of the person purchasing any Kangado Product to ensure they are aware of and fully acknowledge their respective council regulations and state building permits, for each and individual Kangado product.

Kangado will supply and provide copies of product documents and specifications before purchasing the products upon request for additional fees as: engineering drawings.

In any of the KangAdo products price tag, not including the engineering drawings & certification cost.  It is the purchaser’s responsibility to meet the legal requirement of their respective state as Regulation and policies may vary from state to state within Australia.

It is wholly the responsibility of the purchaser to comply with the standards required within their state prior to purchasing their Kangado Product.

If this condition has failed to be met, this will void the warranty for the refund Policy Kangado Practices.

b) It is the responsibility of the person purchasing any of the Kangado Product to ensure:

They are receiving the product in Good order and conditions.

The purchaser has the right to reject the Product if it appears to be significantly damaged externally upon delivery.
In this instance, the receivers form will not be required to be signed.

In the instance that the Kangado Product is opened post delivery and the product appears to be damaged, the immediate evidence is required to be presented and sent to Kangado in order to determine whether this is a Manufacturers fault.

It is not under any circumstance the responsibility of Kangado for wear & tear of the product other than the “5-year Warranty” explanation provided within reasonable terms.
Strictly any Manufacturing faults by Kangado will be under determination upon report under investigation based on evidence provided.
It is not recommended at all, for any damaged product to be used in the commencement of the installation process.

The purchaser is required to return the damaged or faulty item at their own cost, in which Kangado will happily replace with new part/Item at no cost to the purchaser. Once received, Postage fees will be reimbursed back to the customer.

Kangado is not responsible if the damaged or faulty item used in Installation causes further damage to the product. This will be considered contributory negligence. It is the Purchaser and/or a third party assembler (that is not represented or has any affiliation with Kangado) ‘s Responsibility to ensure all items are not damaged and are fit for use for the commencement of the installation process of The Kangado Product.

c) Warranties for Kangado product Explanations

• Aluminium Frame: 5 years against the oxidation (corrosion),

If the item is affected by corrosion in the first 5 years Kangado will arrange to visit and viewing the actual product and upon the report, will take action, of replacing or refurbishing the product.
Warranty will NOT APPLY if appear that the product has Physical damage

If the affected item is a small piece or partial, it needs to be sent to Kangado at purchaser cost, and Kangado will in return, replace product or material at no cost to the purchaser and refund the postage cost.

• Polycarbonated sheets: 5 years for tinted PC sheets

If the Tint or colour of the polycarbonate sheets fade before 5 years ONLY

Purchaser needs to send the sheet or sheets to Kangado at purchaser cost, and Kangado will in return, replace product or material at no cost to the purchaser and refund the postage cost.

• What Our Warranty Will Not Cover once the items are delivered and signed, unpacked and installed?

This warranty will not cover product failure because you broke it (any defect or malfunction that is caused as a result of misuse, failure to follow assembling instructions, abuse, or use of improper or faulty tools). It doesn’t cover incidental damages or made by severe weather ( Storms, Wind, Snow, Hails, Floods, Fire…etc)

KangAdo disclaims liability for replacing or reinstallation  of the product  for FREE, if it’s a physical  damage during the  self-installation, no proper installation, (“Not proper installation disclaimer” doesn’t  apply if KangAdo physically  assembles and installing the product.)

• Cancelling the order

For the order to be made, Kangado will ask for a deposit(usually 40%) as per the agreement, once the deposit is made and afterwards purchaser Cancel the order for any reason, deposit won’t be returned under any condition, except if the order is cancelled by Kangado. The purchaser CAN be charged with extra fees for late cancellation.

7. Limitation of Liability

You understand and agree that www.kangadocarports.com and any of its subsidiaries or affiliates shall in no event be liable for any direct, indirect, incidental, consequential, or exemplary damages. This shall include, but not be limited to damages for loss of profits, business interruption, business reputation or goodwill, loss of programs or information or other intangible loss arising out of the use of or the inability to use the service, or information, or any permanent or temporary cessation of such service or access to information, or the deletion or corruption of any content or information, or the failure to store any content or information. The above limitation shall apply whether or not www.kangadocarports.com has been advised of or should have been aware of the possibility of such damages. In jurisdictions where the exclusion or limitation of liability for consequential or incidental damages is not allowed the liability of www.kangadocarports.com is limited to the greatest extent permitted by law.

8. External Content

www.kangadocarports.com may include hyperlinks to third-party content, advertising or websites. You acknowledge and agree that www.kangadocarports.com is not responsible for and does not endorse any advertising, products or resource available from such resources or websites.

9. Jurisdiction

You expressly understand and agree to submit to the personal and exclusive jurisdiction of the courts of the country, state, province or territory determined solely by www.kangadocarports.com to resolve any legal matter arising from this agreement or related to your use of “KANGADO”. If the court of law having jurisdiction, rules that any provision of the agreement is invalid, then that provision will be removed from the Terms and the remaining Terms will continue to be valid.

10. Entire Agreement

You understand and agree that the above Terms constitute the entire general agreement between you and Kangado . You may be subject to additional Terms and conditions when you use, purchase or access other services, affiliate services or third-party content or material.

11. Changes to the Terms

www.kangadocarports.com reserves the right to modify these Terms from time to time at our sole discretion and without any notice. Changes to our Terms become effective on the date they are posted and your continued use of www.kangadocarports.com after any changes to Terms will signify your agreement to be bound by them.
